- "Buyer" means the Consumer who buys or agrees to buy Goods on this website or by telephone.
- "Goods" means all products listed on the order and the order confirmation e-mail or letter
- "Consumer" has the meaning given in section 12 Unfair Contract Terms Act 1977
- “Made to Measure Items” mean any goods that are made to specific, non-standard dimensions as determined by the Buyer.
- "Delivery" means the delivery of the Goods to the delivery address specified on the order.

makes every effort to ensure that this website is free from viruses or defects. However, due to the nature of the Internet, we cannot guarantee that your use of this website won’t affect your computer. Quiet Night BedsTM
recommends that you purchase the right firewall and anti virus software to use this and other websites and screen out anything that may damage it. Quiet Night BedsTM
shall not be liable in the very unlikely event that while using this website your computer equipment is damaged.
Accuracy of content:

makes every effort to display the colour of the Goods as accurately as possible. But as colour reproduction depends on your computer’s monitor, we cannot guarantee that your monitor’s display of the colour is accurate to the actual Goods.
Risk and Ownership:
Ownership of the Goods will only pass when cleared funds have been received from the Buyer, regardless of whether delivery has taken place.
Limitations of Liability:

shall not be liable for any direct, indirect or consequential losses, costs or expenses incurred or any consequential compensation arising out of the performance/or non performance of this contract. Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded under applicable law. All contracts shall be governed by the relevant UK law. Any order placed by the Buyer and accepted by Quiet Night BedsTM
is subject to these terms and conditions unless specified in writing by a Director of Quiet Night BedsTM
. A confirmation of your order will be sent automatically by e-mail and, unless you are notified to the contrary within 48 hours of this confirmation, the order will be deemed to be accepted by Quiet Night BedsTM. Quiet Night BedsTM
retains the right to refuse any order that is subject to an error on its website and will in these circumstances reimburse the Buyer in full.
Quiet Night BedsTM
retains the right to investigate any order placed on this website or by phone that it suspects to be fraudulent. Any such order will not be delivered until it is proven that the order is bona fide. Should Quiet Night BedsTM
be unable to prove that an order is bona fide or to contact the Buyer then the monies will be refunded to the original payment card used and the order will be cancelled. For your protection, to ensure that your credit, debit or charge card is not being used fraudulently, we will validate your name, address and other personal information supplied by you during the order process against appropriate third party databases. By accepting these terms and conditions you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered Credit Reference Agency which may keep a record of that information. Please be assured that this is only done to confirm your identity. A credit check is not performed and your credit rating will not be affected. All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.
Description of Goods:
The description of the goods will be as specified within an order confirmation e-mail that will be sent to the Buyer as soon as an order is successfully processed. It is the Buyer's responsibility to check that the Goods specified are as the Buyer intended to order. Any discrepancies should be notified to Quiet Night BedsTM
immediately by: Calling Customer Services on 07748984661 Emailing to firstname.lastname@example.org All sizes given are approximate and the Buyer should check carefully that the goods will fit into the delivery address. The normal bed and mattress sizes (i.e. 3, 0" single 4'6" double and 5'0" king) refer to the sleeping surface only and the Buyer should check the overall dimensions given for each product, including depth. Please be aware that mattress sizes may vary slightly from their stated dimensions due to manufacturing tolerances. Most small single mattresses will fit a bunk bed, but please note that top bunks often require a thinner mattress (typically no more than 15cm) to ensure safety regulations are met.
Full payment is required at the time the order is placed and Quiet Night BedsTM
will collect this using PayPal or the debit/credit card details supplied by the Buyer. All Prices and charges on this site are in UK pounds and include any V.A.T payable at the prevailing rate.
Delivery will only be made to the delivery address specified on the original order. Delivery will be deemed to have taken place when the Goods have been delivered to the agreed address. Quiet Night BedsTM
does not need to satisfy itself that the person accepting delivery at the agreed address is authorised by the Buyer to accept the Goods. All delivery costs will be calculated based on the number of items to be delivered, availability of a delivery vehicle, your location and complexity of delivery. The full delivery cost will need to be paid before the order is processed. Delivery restrictions do apply to certain, outlying postcode areas. Please email email@example.com if you would like to clarify the delivery options available in your area. Delivery to postcodes outside mainland UK are not available. Delivery will normally take place within the timescale estimated when placing the order. Some products for customers in outlying postal code areas may take longer. Quiet Night BedsTM
reserves the right to change delivery times with a commitment to inform the Buyer. Goods should be inspected upon delivery and any issues (e.g. damages, missing parts) should be notified to Quiet Night BedsTM
, within 14 days if possible, so that a remedy can be agreed. Delivery costs already paid will not be refunded under any circumstances.
Returns & Cancellation:
The Buyer may cancel the goods at any point after placing their order, but no later than 14 working days after the day of delivery. Made to Measure Items (see definitions) cannot be cancelled once the order has been accepted. Due to the hygiene aspects associated with some items (e.g. mattresses, pillows, mattress protectors, duvets), Quiet Night BedsTM
reserves the right to reject cancellation if these items have been used. This does not apply if the items in question are found to be faulty. Buyers can open the packaging to inspect a product on delivery, but, if they are then rejected, the Buyer must take good care of the Goods until they are collected by Quiet Night BedsTM
(or its agents). The Goods must be unused, in their original condition and made available for collection at a time agreed with Quiet Night BedsTM
. The collection date should not exceed 30 days from the cancellation date. Quiet Night BedsTM
will collect unused goods which are damaged or faulty free of charge. Unwanted items, that are in good working order, will incur a delivery fee based on the number of items to be returned, availability of a delivery vehicle, your location and complexity of removal. Alternatively the Buyer may return the Goods (at the Buyers cost) in their original condition and adequately packaged to prevent damage to our factory. Following collection or return, if the Goods are found to be damaged (and the damage is not the result of our actions), Quiet Night BedsTM
will seek to recover the cost of remedying the damage from the Buyer.
Refunds for Goods cancelled will be made as soon as possible following notification from the Buyer of intention to cancel. This will not exceed a period of 30 days from that notification. All refunds will be made onto the same card/payment method that was used to make the original purchase. If you participated in a linked saving offer (e.g. buy a bed for £999 and get £200 worth of free bedding) you must return both items to get a full refund. If you only return the bed in the given example, you will be refunded only £799 to cover the price of the bedding as you no longer qualify for the offer. If you participated in a ‘multibuy’ offer (e.g. buy 3 for the price of 2) and return part of this order then any saving will be deducted from your refund as the offer no longer applies.
All Goods are guaranteed against faulty materials and workmanship for a minimum period of 30 days from the date of delivery. Where Goods are reported as faulty, Quiet Night Beds'
usual approach is to arrange an independent inspection to verify the fault. This does depend on the nature of the fault or time elapsed since delivery. If this inspection finds no fault with the product (e.g. the issue has resulted from wear and tear, negligence, wilful damage or mis-use), Quiet Night BedsTM
will decline any further action, but provide full details of the reasons for the decision. The Buyer will have direct access to any reports completed by the inspection specialist. If the Buyer would prefer to use an inspection service of their choosing, then this must be done at the Buyer’s cost. Please note that any inspection service used must be a recognised, independent specialist. In the rare event that Goods are found to be faulty, Quiet Night BedsTM
will follow a fair and fast process. This will be in line with your statutory consumer rights and could include a repair, replacement or refund depending on the specific circumstances.

- Quiet Night BedsTM will not be responsible for the failure to carry out its obligations under this agreement if this is caused by circumstances outside its reasonable control
- Buyers may be asked to provide proof of purchase when making a claim
